Health Insurance Claim Rejected Over Alleged Pre-Existing Disease? Two Consumer Court Rulings Explain Why Insurers Must Support Their Claims With Evidence

Two consumer commission rulings have rejected insurers’ attempts to rely on medical-history allegations they could not prove. Reports from Udupi and Srinagar describe gaps ranging from conflicting hospital notes to the absence of a proposal form.

A health insurance claim rejected for alleged non-disclosure needs scrutiny of what the applicant knew and declared. The decisions leave policyholders’ disclosure duties intact, along with any valid waiting periods or exclusions.

Key Highlights

  • Udupi’s commission questioned inconsistent medical-history entries and an absent proposal form.
  • Srinagar’s commission found insufficient evidence of an allegedly undisclosed cardiac condition.
  • The Srinagar award distinguished documented hospital charges from unsupported additional expenses.
  • Match the rejection letter’s explanation against the relevant policy terms and dated medical records.

Udupi: Conflicting Medical Notes And A Missing Proposal Form

The Udupi District Consumer Disputes Redressal Commission examined an insurer’s refusal to reimburse a woman’s surgery expenses in a ruling dated 1 October 2026. She sought reimbursement of ₹1,26,441 after treatment for abnormal uterine bleeding.

The insurer alleged that symptoms predated the policy. Two gaps weakened its position:

  • An earlier note mentioned bleeding for three to four years, while the discharge summary recorded roughly one-and-a-half years.
  • The insurer did not produce the proposal form showing its medical questions and the applicant’s answers.

The commission found insufficient evidence of the alleged non-disclosure. The reported relief totalled approximately ₹1.56 lakh for reimbursement, compensation and litigation costs. Without the proposal form, the insurer could not demonstrate which disclosures the applicant had made.

Srinagar: An Allegation In A Rejection Letter Was Not Proof

In Srinagar, a woman’s ankle fracture after an August 2024 fall led to a dispute decided on 22 October 2026. The insurer relied on an allegedly undisclosed heart condition to refuse reimbursement under a renewed policy.

The commission found that the policy covered the wife and that hospital records established treatment during the insured period. It also found the insurer had not proved the alleged cardiac condition existed at the relevant time or that material information had been deliberately withheld.

The award comprised ₹84,370 in documented hospital expenses, ₹50,000 compensation and ₹2,000 litigation costs, totalling ₹1,36,370. Additional claimed spending lacked independent documentary support.

A weak rejection does not establish every rupee claimed. Preserve invoices and payment evidence alongside the medical records used to challenge the insurer’s allegation.

What Evidence Should A Rejection Actually Address?

Start with the precise reason in the repudiation letter. Alleged non-disclosure and a waiting-period exclusion raise different questions; assess the insurer’s argument against the actual policy wording and facts.

The reported disputes suggest this document check:An illness recorded during hospitalisation does not, by itself, establish what the applicant knew when answering an earlier proposal. Equally, these findings do not erase a valid contractual exclusion. Ask the insurer to explain how its evidence supports the particular ground used.

How To Challenge A Rejected Health Insurance Claim

Write to the insurer’s Grievance Redressal Officer before choosing an escalation route. IRDAI’s grievance guidance recommends a written complaint with supporting documents and a dated acknowledgement.

Set out where you disagree with the rejection:

  • Obtain the proposal form and ask which policy clause supports the rejection.
  • Point out discrepancies in the medical history and cite the dated records supporting your account.
  • Provide bills for the expenses claimed, along with copies of the policy schedule and rejection letter.
  • Request the review decision in writing, with reasons. Retain the acknowledgement showing when the insurer received your complaint.

You can register an unresolved grievance on IRDAI’s Bima Bharosa portal and follow its progress there. If the insurer’s reply does not resolve your complaint, or no reply arrives within 30 days, you may approach the Insurance Ombudsman. Check that your complaint qualifies and falls within the relevant filing deadline.

Having a health insurance claim rejected does not end the dispute. Use the relevant records to challenge the insurer’s stated reason, then choose the appropriate complaint route.

FAQs

Does a pre-existing disease always justify rejecting a claim?

No. Coverage depends on the policy’s terms, applicable waiting period and disclosure history. The insurer must establish that the particular reason it relies upon supports rejecting the claim.

Can I approach the Ombudsman and consumer commission together?

The Ombudsman procedure excludes complaints already taken to another forum, court or arbitrator on the same dispute. Choose the route carefully before filing parallel proceedings elsewhere.

Is filing an Insurance Ombudsman complaint free?

Yes. The Council for Insurance Ombudsmen states that it charges no filing fee. Eligibility, jurisdiction, and time limits still apply, including the requirement to first approach the insurer.

What is the Ombudsman’s financial limit?

The published procedure covers claims, including expenses, not exceeding ₹50 lakh. Your complaint must also fall within the office’s territorial jurisdiction and meet the filing deadline.

Which documents does the Ombudsman ask for?

Submit the policy, rejection letter, and your written complaint to the insurer. For disputes involving pre-existing disease or waiting periods, also provide earlier policies and relevant correspondence.
